MAKUKU GENERAL TRADING L.L.C ("MAKUKU")

Introduction

This document governs the terms, conditions, and privacy policy applicable to all official services and platforms, including promotional activities under the MAKUKU trademark, conducted by MAKUKU GENERAL TRADING L.L.C (the "Company") as the license holder of the MAKUKU brand in the United Arab Emirates ("UAE").

By accessing, using, or participating in the Company’s services, either online or offline, you are deemed to have read, understood, and agreed to these terms, conditions, and policies.

1. Scope

These terms and conditions apply to all activities conducted through:

  • Official MAKUKU website and applications.
  • Official social media (Instagram, TikTok, Facebook, YouTube, etc.).
  • Official communication channels (WhatsApp bot, call center, email).
  • Official e-commerce (MAKUKU Official Store on marketplaces).
  • Loyalty programs, communities, sampling, offline events, promoters (SPG), and promotions with official partners.

2. Intellectual Property Rights

All content on MAKUKU’s official platforms is the property of the Company as the legitimate license holder and is protected under UAE federal laws.

3. Use of Content & Participation

  • Users may only use the content for personal, non-commercial purposes.
  • Users may quote content provided that the official source and backlink are included.
  • Republishing or commercial exploitation is only permitted with the Company’s prior written consent.

4. Personal Data & Consent

  • By providing personal data, users consent that such data may be used for identity verification, marketing communications, product offers, consumer analysis, and other legal purposes.

5. User Generated Content

Any material uploaded by users grants the Company a non-exclusive, royalty-free, transferable license to use such content in accordance with applicable law.

6. Limitation of Liability

  • Information on MAKUKU platforms is general in nature and not intended as professional advice.
  • Users are solely responsible for the use of such information.
  • The Company is not liable for any losses resulting from the use of information or external links.

7. Promotions, Competitions, and Loyalty Programs

The Company reserves the right to hold promotions, competitions, sweepstakes, and/or loyalty programs on all MAKUKU platforms. Each activity will be subject to additional terms announced at the time of execution.

8. Amendments

The Company reserves the right to add, reduce, or amend these terms & conditions whenever deemed necessary for operational, service, or legal purposes. Changes take effect once announced on official MAKUKU platforms.

9. User Rights on Personal Data

In accordance with UAE PDPL（UAE Federal Decree-on the Protection of Personal Data） and other applicable regulations, you have the following rights regarding your personal data:

  • Access and obtain a copy of your personal data
  • Correct or update inaccurate data
  • Request deletion or erasure of your data under certain conditions
  • Withdraw consent at any time, without affecting the lawfulness of prior processing
  • Object to or restrict processing of your personal data
  • Request transfer of your data where feasible
  • Lodge a complaint with the UAE Data Office or seek judicial remedy for violations

10. Governing Law and Dispute Resolution

These terms & conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of the Emirate of Dubai, UAE.

11. Sanctions for Violations

The Company reserves the right to take appropriate action against users who violate these terms, including but not limited to:

  • Fraud, scams, or falsification of data.
  • Unauthorized sale of samples or promotional items.
  • Unauthorized commercial use of materials.

Sanctions may include:

  • Written warnings (email/WhatsApp).
  • Temporary suspension of account/membership.
  • Permanent deletion of account/access.
  • Revocation of promotions/loyalty benefits obtained unlawfully.
  • Cancellation of product replacement rights if terms are not met.
  • Pursuit of legal action under UAE law, which may involve civil or criminal penalties.

12. Consent

By accessing, using, or participating in official MAKUKU platforms (online or offline), users acknowledge that they have read, understood, and agreed to these terms & conditions, and consent to the use of their personal data in accordance with UAE PDPL.
